We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of services and pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any service at any time. We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

SECTION 10A – DIRECT MARKETING COMMUNICATIONS (EMAIL AND SMS)
By providing your email address and/or mobile number to FibroSculpt and choosing to engage our services (for example, by making a booking, purchasing a pack or joining our mailing list), you acknowledge and agree that:

marketing and promotional communications about FibroSculpt services, packs, special offers, events and updates that are relevant to the services you receive from us.

When you choose to engage our services and provide your contact details, you consent to us contacting you by email and/or SMS for:-
essential service communications; and

marketing about similar services, treatment programs and offers that we reasonably believe may be of interest to you as a client.
Where required by law, we will also provide a clear option (such as a tick box) for you to actively opt in to receive promotional communications.

Right to Opt Out (Unsubscribe)
You may opt out of receiving marketing communications from us at any time by:-
clicking the “unsubscribe” link in an email;

replying “STOP” (or as otherwise instructed) to an SMS; or

contacting us at hello@fibrosculpt.com.au and requesting to be removed from our marketing list.
Once you unsubscribe, we will stop sending you marketing messages within a reasonable time. You may still receive non-marketing messages relating to your appointments, payments or other essential service communications.

No Unfair Requirement for Marketing Consent
Where required by law, your ability to obtain services from FibroSculpt will not be conditional on consenting to receive marketing communications, and you are free to withdraw consent at any time without penalty (other than not receiving marketing offers). -

We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.
You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and Services delivered to you through the Service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall FibroSculpt, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility.
Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless FibroSculpt and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
SECTION 15 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 16 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
SECTION 17 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Australia.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
SECTION 20 - CANCELLATION POLICY
Cancellation Policy: At least 24 hours’ notice is required to reschedule or cancel an appointment for a refund or to credit a prepaid appointment to another date. Notice given less than 24 hours in advance will forfeit the prepayment for that appointment, with no exceptions. By completing your booking, you acknowledge and accept these terms and conditions. During the booking process, you acknowledge and accept these terms and conditions.

General Cancellation Policy:
- At least 24 hours’ notice is required to reschedule or cancel an appointment for a refund or to credit a prepaid appointment to another date.
- Notice given less than 24 hours in advance will result in the forfeiture of the prepayment.
- Failure to attend an appointment without prior notice will also result in the forfeiture of the prepayment.

Illness Policy:
- If a client cannot attend their appointment due to illness, they must notify FibroSculpt at least 24 hours in advance to retain their prepayment.
- Cancellations made with less than 24 hours’ notice due to illness will result in forfeiture of the prepayment.
- Clients who show up visibly unwell will be asked to reschedule, and the prepayment for that appointment will not be refunded or credited.

Booking Errors by Clients:
- Clients are responsible for ensuring that all booking details, including date, time, and service selection, are accurate at the time of booking.
- Refunds will not be issued for booking errors made by the client.
- To reschedule an appointment due to a booking error, the client must provide at least 24 hours’ notice.
- Failure to provide adequate notice for rescheduling due to a booking error will result in the forfeiture of the prepayment

Prepaid Appointments:
- Prepaid appointments with sufficient notice can be credited toward a future booking, subject to availability.
- Prepayments will be forfeited for cancellations, no-shows, or rescheduling requests made with less than 24 hours’ notice, regardless of the reason.
SECTION 21 - RESULTS DISCLAIMER
At FibroSculpt, we are committed to providing high-quality treatments, including body contouring, skin tightening, fibrosis reduction, and post-operative care. However, individual results may vary based on personal factors such as body type, health, adherence to aftercare, and individual response to treatment.
No guarantees of specific outcomes are made for any treatment. Clients acknowledge that results depend on multiple factors outside FibroSculpt’s control. Refunds will not be issued for treatments that do not meet personal expectations or desired results, as treatment efficacy is inherently variable.
By proceeding with any treatment, clients accept that they undertake it at their own discretion and assume all associated risks. FibroSculpt disclaims any liability for variations in treatment outcomes and will not be responsible for any perceived lack of results.
SECTION 22 - FEEDBACK AND PUBLIC REVIEWS POLICY
FibroSculpt is committed to delivering high-quality treatments and values constructive client feedback. By booking or using our services, you acknowledge and agree to the following:
Constructive Communication
We encourage clients to contact FibroSculpt directly to discuss any concerns or dissatisfaction with services. This gives us the opportunity to review your treatment, clarify expectations (including the variability of results described in Sections 21 and 23), and work with you to resolve issues where possible.
Honest and Accurate Feedback
All feedback, whether private or public (including but not limited to Google Reviews and other online platforms), must reflect:

a truthful, genuine account of your own personal experience;
-
information that is not false, misleading, exaggerated or taken out of context; and
-
a fair reflection of the service provided, acknowledging that body-sculpting outcomes depend on individual factors such as anatomy, lymphatic function, lifestyle (including diet and alcohol intake), health status, and adherence to aftercare.
Clients acknowledge that choices such as poor diet (for example, regular consumption of high-calorie foods after treatment), inadequate hydration, limited physical activity, smoking, alcohol intake, poor lymphatic function, or failure to follow aftercare can significantly affect outcomes and are not the fault of FibroSculpt or its practitioners.
Platform and Content Policy Compliance
Public reviews must comply with the terms and content policies of the platform on which they are posted (for example, Google’s content and review policies). You agree that your reviews will not contain:

knowingly false or misleading statements;
-
defamatory, harassing, abusive or hateful language;
-
content unrelated to the services you personally received;
-
content posted by or on behalf of a person who has not been a client; or
-
spam or promotional material disguised as a review.
Our Right to Challenge Certain Reviews
If we reasonably believe that a review:

is false, misleading, or not based on your actual experience;
-
unfairly attributes lifestyle- or health-related factors (such as diet, alcohol intake, poor lymphatic function, or failure to follow aftercare) to the quality of our services;
-
is defamatory, harassing, abusive, or otherwise unlawful; or
-
breaches the applicable platform’s review or content policy,
then we reserve the right to:

respond to the review publicly or privately to provide clarification; and/or
-
report, flag or otherwise request that the platform (e.g. Google) review the content for potential removal in line with that platform’s policies.
You acknowledge that FibroSculpt cannot guarantee the removal of any review. The decision to remove or retain a review always remains at the sole discretion of the platform (such as Google), in accordance with its own policies and procedures.
Legal Rights Reserved
Nothing in this section limits FibroSculpt’s right to pursue any legal remedies available under Australian law in relation to reviews or statements that are clearly defamatory, malicious, unlawful or cause serious harm to our reputation or business. However, we will generally seek to resolve concerns collaboratively and through the relevant platform’s reporting process before considering formal legal action.
SECTION 23 - ELIGIBILITY AND SUITABILITY FOR TREATMENTS
Eligibility and Suitability: Clients acknowledge that eligibility and suitability for treatments at FibroSculpt vary based on individual health, medical history, and personal circumstances. Not all clients may be eligible for certain treatments, and FibroSculpt reserves the right to determine client suitability based on professional assessment and ethical considerations.
Consultation Requirement: FibroSculpt offers an initial consultation to discuss client needs, expectations, and any limitations of the treatments offered. Clients are encouraged to use this consultation to ask questions, clarify expectations, and understand any limitations or contraindications relevant to their desired treatment.
Contraindications: Certain health conditions may prevent clients from undergoing specific treatments. Clients agree to disclose all relevant medical information, including but not limited to recent surgeries, medical implants, skin conditions, allergies, and other health issues that could affect treatment safety or outcomes. FibroSculpt reserves the right to decline treatment if contraindications are identified, and is not liable for any adverse effects that arise due to undisclosed health information.
Variability of Results: Treatment outcomes vary depending on individual factors, such as age, health, lifestyle, and adherence to aftercare instructions. Clients understand that FibroSculpt does not guarantee specific results, and no compensation, refunds, or re-treatment will be provided based on perceived lack of results if treatments are administered in accordance with professional standards.
Client Responsibility and Assumption of Risk: By proceeding with any treatment, clients confirm they are fully aware of the limitations, contraindications, and potential variations in results associated with their chosen service. Clients voluntarily assume all risks associated with the treatment and agree that FibroSculpt is not liable for outcomes that do not meet personal expectations.
No Warranties for Outcomes: FibroSculpt makes no express or implied warranties regarding the effectiveness of any treatment, and outcomes are not guaranteed. By booking and receiving treatments, clients agree that results are subject to individual variability, and FibroSculpt shall not be held liable for any dissatisfaction or failure to meet personal expectations.
By booking or engaging in services with FibroSculpt, clients acknowledge and accept this Eligibility and Suitability policy and agree that they have reviewed their treatment options and understand all associated risks and limitations. Failure to disclose relevant health information or to comply with pre-treatment requirements may result in treatment refusal or termination, without eligibility for refunds or compensation.
SECTION 24 - PHOTO CONSENT AND USAGE DISCLAIMER
Purpose of Photos: By engaging in services with FibroSculpt, clients consent to the taking of before-and-after photos to document progress, assess treatment outcomes, and improve service quality. These photos are crucial for tracking individual progress and ensuring accurate treatment evaluation.
Usage and Ownership: All photos taken by FibroSculpt are the exclusive property of FibroSculpt. Clients agree that these images may be used for marketing, educational, or promotional purposes, including but not limited to publication on the FibroSculpt website, social media, and other marketing materials.
Anonymity and Privacy Protection: FibroSculpt is committed to maintaining client privacy. Identifiable features, such as faces or distinctive markings, will not be shown in public-facing materials without the client’s explicit, written consent. All images will be handled with care to ensure client confidentiality, in accordance with privacy laws.
Client Acknowledgment and Consent: By proceeding with treatments at FibroSculpt, clients acknowledge and consent to the use of their photos as outlined in this disclaimer. Clients understand that FibroSculpt retains the right to use these images for lawful purposes related to business promotion and service quality assessment. This consent is irrevocable and does not require further approval for each specific use.
Opt-Out Provision: Should clients wish to restrict the use of their images for promotional purposes, they must provide written notice to FibroSculpt prior to treatment. Opting out may not apply to images used for internal tracking and treatment evaluation, which remain necessary for service provision.
By receiving treatment at FibroSculpt, clients agree to this Photo Consent and Usage Disclaimer and confirm their understanding that all photos are the property of FibroSculpt, intended for legitimate business purposes.
SECTION 25 - RETURN AND REFUND POLICY

No Refunds on Completed Services
Once a service has been provided, it is considered complete and non-refundable. -
No Refunds on Pack Purchases
All multi-session packs are non-refundable. If a client chooses not to complete a pack, a store credit can be issued for the unused sessions, provided the cancellation policy has been followed. The credit amount will be calculated based on the regular, per-session rate for sessions already used, not the discounted pack rate. Any remaining balance will be issued as store credit, which can be applied toward future services at FibroSculpt. -
Cancellation Policy Compliance
To qualify for any store credit on unused sessions within a pack, clients must adhere to the Cancellation Policy (Section 20), which requires a minimum of 24 hours notice for rescheduling or canceling appointments. Failure to provide sufficient notice may result in the forfeiture of that session’s value. -
Non-Refundable Administrative Fees
FibroSculpt reserves the right to deduct administrative fees for certain services associated with processing and maintaining client accounts. These non-refundable administrative fees may include, but are not limited to:- Booking Platform Fees: Costs associated with managing and processing bookings via third-party platforms.
- Automated Reminder Services: Fees incurred for automated reminders, confirmations, and follow-up communications.
- Payment Processing Fees: Charges from financial institutions or payment processors for handling transactions.

SECTION 26 - REFUSAL OF SERVICE POLICY
FibroSculpt reserves the right to refuse or discontinue service to any client at our discretion to maintain a respectful and positive environment for clients and staff. If we decide to end the service relationship, a refund for any unused sessions will be offered as a goodwill gesture.
By booking with FibroSculpt, clients accept this Refusal of Service Policy.
SECTION 27 - TREATMENT RISKS, POTENTIAL SIDE EFFECTS, AND LIMITATION OF LIABILITY
At FibroSculpt, we are dedicated to providing treatments in line with professional standards and protocols to prioritise client safety. However, all treatments inherently carry risks. By proceeding with any treatment, the Client acknowledges the potential side effects and accepts the terms outlined below, which limit FibroSculpt's liability to the fullest extent permissible under Australian law.
Acknowledgement of Risks
The Client understands and accepts that the following potential side effects may arise from treatments provided by FibroSculpt. These side effects are typically mild and temporary but may vary depending on individual responses:
- Redness, Swelling, and Inflammation: Temporary reactions in the treated area that usually subside within a few days.
- Bruising: Mild to moderate bruising, particularly in sensitive or vascular areas.
- Tenderness or Discomfort: Temporary tenderness, soreness, or discomfort following treatment.
- Warmth or Heat Sensations: Warm sensations during or after treatment, which typically resolve quickly.
- Skin Sensitivity: Temporary tingling, flushing, rash, or increased sensitivity in the treated area.
- Vascular Changes: Temporary visibility of superficial veins, skin tone changes, or mild vascular effects.
- Skin Laxity: Rare but possible temporary skin laxity or overstimulation of tissue.
- Rare Complications: Burns, blisters, pigmentation changes, uneven results, tissue hypersensitivity, or subcutaneous fat atrophy.
- Other Rare Effects: Bloating, nerve irritation, or prolonged sensitivity.
The Client acknowledges that these risks are known and inherent to the treatments offered, and results may vary significantly based on individual factors. FibroSculpt adheres to professional standards to minimise risks and ensure safe treatment practices.
Limitation of Liability
FibroSculpt will not be held liable for any side effects, complications, or outcomes arising from treatments, provided:
- Procedures were conducted according to professional standards, safety protocols, and manufacturer guidelines.
- The Client provided accurate and complete health information before treatment.
- The Client complied with all pre-treatment and post-treatment care instructions.
This limitation of liability does not exclude or restrict liability for claims arising from negligence, a breach of mandatory consumer guarantees under the Australian Consumer Law, or any other liability that cannot be excluded by law.
Client Responsibilities
To minimise risks and ensure safe and effective treatments, the Client agrees to:
- Accurate Disclosure of Medical Information: Provide complete and accurate information regarding their medical history, allergies, medications, and any other factors that may affect treatment.
- Notification of Changes to Medical History: Inform FibroSculpt of any changes to their medical history, health status, or medications prior to receiving further treatments.
- Compliance with Pre- and Post-Treatment Instructions: Follow all guidance provided by FibroSculpt to optimise treatment outcomes and minimise risks.
- Reporting of Reactions: Notify FibroSculpt immediately if unexpected or concerning side effects occur following treatment.
Failure to disclose relevant health information or adhere to provided instructions may increase the risk of adverse effects. FibroSculpt is not liable for outcomes or complications resulting from such omissions.
Results Disclaimer
FibroSculpt makes no guarantees regarding specific treatment outcomes. Results vary widely based on individual factors, including but not limited to skin type, health status, and adherence to aftercare instructions. The Client acknowledges that dissatisfaction with treatment outcomes does not constitute grounds for a claim against FibroSculpt.
Acknowledgment and Agreement
By proceeding with any treatment, the Client confirms that they have read, understood, and accepted the risks, responsibilities, and limitations outlined in this section. This acknowledgment applies to all treatments provided by FibroSculpt, both current and future.
SECTION 28 - CLIENT RESPONSIBILITY FOR SCHEDULING
FibroSculpt operates with limited hours, so clients are encouraged to book all sessions in advance to ensure availability. It is the client’s responsibility to:
- Book Ahead: Schedule sessions early in the treatment program to secure recommended intervals.
- Align with Operating Hours: Ensure that FibroSculpt’s hours match the client’s availability before committing to a program.
- Maintain Results: FibroSculpt is not responsible for missed sessions or changes in results due to delays or last-minute bookings.
By starting a treatment program, clients agree to manage their own bookings and accept that any impacts on results from missed sessions are their responsibility.
SECTION 29 - FORCE MAJEURE
FibroSculpt is not liable for delays or failures to perform services due to causes beyond our reasonable control, including but not limited to natural disasters, acts of government, pandemics, or labour disruptions. If a force majeure event affects FibroSculpt's ability to deliver services, we will make every effort to communicate with affected clients and reschedule appointments where possible.
SECTION 30 - NON-TRANSFERABLE PACKAGES AND CREDITS
All services, packs, and credits purchased from FibroSculpt are non-transferable and intended solely for the original purchaser’s use, unless purchased as a gift certificate. Gift certificates may be redeemed by the recipient designated at the time of purchase. FibroSculpt reserves the right to refuse service to any party attempting to redeem services purchased under another individual’s name, except in the case of an approved gift certificate.
SECTION 31 - COVID-19 AND HEALTH-RELATED PRECAUTIONS
FibroSculpt follows strict health protocols to ensure client and staff safety, including measures for sanitisation, hygiene, and health screenings. Clients experiencing any symptoms of illness are required to reschedule appointments at the earliest possible notice. FibroSculpt reserves the right to refuse service to clients who appear unwell or fail to comply with health and safety policies.
SECTION 32 - CLIENT RESPONSIBILITY FOR FOLLOW-UP CARE
Certain treatments offered by FibroSculpt require follow-up care or maintenance for optimal results. Clients agree to follow all post-treatment instructions and attend any recommended follow-up sessions. FibroSculpt is not responsible for outcomes affected by the client’s failure to adhere to post-treatment care recommendations.
SECTION 33 - CLIENT RESPONSIBILITY FOR READING PRE-APPOINTMENT PACK
If a client fails to read the pre-appointment pack but proceeds with booking and payment, it is understood that they have agreed to all terms, risks, and contraindications outlined within. FibroSculpt is not liable for any adverse outcomes resulting from failure to read and comply with pre-appointment information. Payments for appointments in such cases are non-refundable.
SECTION 34 - DISCLAIMER FOR ADVICE GIVEN DURING TREATMENTS
Any health, skincare, or body advice provided by FibroSculpt practitioners during a treatment session is intended as general guidance only. Clients should consult a healthcare professional before making any changes to their health or treatment plans based on advice given during FibroSculpt services. FibroSculpt is not liable for actions taken based on treatment-related advice.
